Three employees were at a worksite. A nearby mini excavator was digging a small excavation with the rear of the excavator facing the rear bed of a dump truck. The injured employee began to retrieve tools from the truck as the mini excavator was backing up. The employee was struck by the rubber track of the excavator, resulting in a knee contusion and ankle fracture.
