Employee was helping build scaffolding approximately 40 feet in the air. His tool ran out of power and he asked his assistant on ground to get his spare batter out of his car

Injured realized his keys were in his pants and needed to detach harness to get keys out. As he turned to throw the keys down he slipped and fell with his keys to his immediate death.
