Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
Exposed to the hazard of being struck or crushed by the Caterpillar
Front End Loader. Employee operating a 1986, 966D Caterpillar Front
End Loader with a audible warning reverse alarm which was inoperable
causing serious injury to the truck driver of a 1987 R Model Mack
Truck when the loader backed into the truck.
A feasible and available method of abatement is to remove the switch
operated by the operator and maintain the audible reverse in an operable
condition when the lever is placed in the revers position at all times.
