Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazards of fractures, lacerations and concussions while operating
a Model 543 Bobcat skid steer loader (S/N 5024M21825) with a 60"
Sweeper (LR60, S/N 434700360). The Model 543 Bobcat used to clean
excess spilled coke and dust from two benches on the coke battery,
was subject to overturning due to overloading and exceeding the
tipping radius of the vehicle as the use of the 60" Sweeper was not
approved by the manufacturer for use in the combination with Model
543 Bobcat loader.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is, but is not limited to:
Replacing the Model 543 Bobcat loader with a larger model loader capable
of safely handling the 60" sweeper according to the manufacturer's
specifications, eg, Bobcat Model 843 or Model 2000, or Models 700,825
or 11600 with a restricted lifting height of 36".
