Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falling either one, two or three floors while riding in the #2 elevator because of transporting equipment such as the Clark grab truck #47 that exceeds the elevators rated capacity of 6,000 lbs. One feasible and acceptable abatement method is to institute an educa- tion and enforcement program to assure the elevator is never overloaded as specified in ANSI A17.1-1987 American National Standards Institute Safety Code for Elevators and Escalators Rule 207.66.
