The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a recognized hazard of electrical shock or burns: (a) M/V Woodbine: Employees working and entering the lower compressor room had occasion to walk near an electrical panel box that had the deadfront cover removed, exposing live electrical conductors. This condition exposed employees to possible contact with the live electrical conductors. Among other methods, one acceptable and feasible means of abatement would be to replace the cover over the panel box as designed by the manufacturer.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a recognized hazard of electrical shock or burns: (a) MV Woodbine: Employees in the compressor room had occasion to work near electrical installations/wiring that was not approved as permanent wiring. This condition exposed employees to possible abraded wires with insulation damage and overheated wiring. Among other methods, one feasible and acceptable abatement method is to install the proper wiring for permanent installation. (b) M/V Woodbine: Employees in the Fidlay room had occasion to work near an electrical installation that was not approved as permanent wiring. Small appliance two strand electrical cord was run from an electrical panel breaker box through a floor to a light below the floor. This condition exposed employees to abraded insulation and possible overheated wires, creating a hazard to the employees in the area. Among other methods, one feasible and acceptable method of abatement would be to install the proper wiring for the intended usage.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a recognized hazard of electrical shock and burns: (a) M/V Woodbine: Employees entering and/or working in the dry storage area were exposed to three unguarded 110-volt electric light bulbs approximately 50 inches off the floor and mounted on the face of an electrical control box. Employees were exposed to the hazard of electrical shock and burns in the event that the bulbs were broken and contact was made with live bare conductors. Among other methods, one feasible and acceptable method of abatement would be to install appropriate bulb guards.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of inadvertent release of energy: (a) M/V Woodbine: Employees had occasion to work on and maintain equipment such as air compressors, refrigeration units, pumps, and cranes, among other equipment, and were not protected by a lockout/tagout program to control energy sources. This condition exposed employees to the inadvertent release of energy and possible injuries during maintenance operations. NOTE: Elements of a minimal energy control program include: 1. Develop, document and utilize procedures for the control of potentially hazardous energy. 2. Provide protective materials and hardware. 3. Perform inspections to ensure the requirements of the program are met. 4. Provide employee training to ensure the purpose and function of the program are understood and that employees have obtained knowledge and skills required for the safe application, usage and removal of energy controls.
