Section 5(a)(1) of the Occupational Safety and Health Act of 1970:   The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause  death
or serious physical harm to employees in that employees were exposed to:
(a)  Jackson Creek Salvage Sale - On or about March 9, 1991
and at times prior thereto, an employee was exposed to
the  hazard  of  being  struck  by a falling tree that
kicked back off the stump.  The hazard was created  by
not placing the back cut above the level of the  upper
horizontal cut of the under cut, thus failing to leave
adequate holding wood.
Among other methods, one feasible and  acceptable  abatement  method  to
to correct this hazard is:
(1)  Place back cuts as level as possible and be  above  the
level of the upper horizontal cut of  the  undercut  as
per  Idaho  Minimum  Safety  Standards  and  Practices,
Chapter H, Standard 18(m).
(2)  Train and require that all fallers, in the accepted way
of installing a  back cut, to  undercut fall  trees  in
the desired location.
(3)  Orientation of new employees and  review  with existing
employees  by  frequent  visual  observations  of  work
practices with written documentation  on  any  problems
with accepted safe work practices.
