Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard created by the lack of warning for oncoming motorists that driving conditions had changed due to the employees' presence in and around the roadway: a. Clinton St., Bow, NH, Tree Trimming Operation - The employer did not provide adequate warning about or channelling of oncoming motor vehicle traffic where the width of the travel lane was reduced due to the existence of employees, an aerial lift truck and trailer mounted chipper in and around the travel lane. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to set up warning cones from the side of the roadway to the corner of the truck of an appropriate length in order to channel the traffic away from the side of the road, where work is being performed, toward the left side of the travel lane.
