Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: hazards related to rough terrain forklift truck operation.
(a)Peachtree Place Apartments: A rough terrain forklift truck was used to
lift people in a
manner that violated industry standards in that:
(1) The platform was not securely attached to the lifting carriage or
forks.
(2) The floor dimensions of the platform exceeded two times the load
center distance
listed on the forklift truck nameplate, measured parallel to the
longitudinal center plane
of the truck.
(3) The platform was not maintained horizontal but was tilted to allow
access
to the
building to attach sheets of plywood.
(4) The platform was not lowered before moving to make adjustments in
positioning.
(5) People were allowed to enter and exit the platform when it was not at
floor level.
(6) Required restraining means such as railings, chains, cable, or body
belt(s) with
lanyard(s)  were not in place and properly used.
(7) The rough terrain forklfit truck control(s) were not in neutral and
the parking brake
set.
(8) The lifting carriage and forks had not been secured to prevent them
from pivoting
upward and the rotators had not been deactivated.
(9) The area was not marked to warn of work by elevated personnel.
(10) Information was not prominently indicated on the platform of the
maximum work
load including personnel and equipment and the weight of the empty
platform.
Among other methods, two feasible and acceptable abatement methods to
correct this
hazard are to:
(1) Use a method to perform the work that does not involve elevating a
person on a
rough terrain forklift truck, and
(2) Follow the practices for safe elevation of personnel on rough terrain
forklift trucks
detailed in the industry standard, "Safety Standard for Rough Terrain
Forklift Trucks,"
ASME/ANSI B56.6-1992.
