Section 5(a)(1) The employer did not furnish employment and a place of
employment which
were free from recognized hazards that were causing or likely to cause
death or serious
physical harm to employees in that employees were exposed to:
(a)In that; employees were exposed to hazards created by the use of
elevated
work platforms which were not designed, constructed and/or used in
accordance with the acceptable requirements of the American National Safety
Standard for Rough Terrain Forklift Trucks, ASME/ANSI B56.6-1987.  For
example: The personnel platform did not meet the design requirements of
that
standard in the following area: (1) Platform dimensions exceeded in width
more than ten (10) inches greater than the overall width of the truck on
either
side (2) Work platform was not prominently marked with both the empty
weight and maximum work load including personnel and equipment.
The above conditions were observed to exist on February 10, 1999 at the
construction worksite located at 6214 South 13th Street, Milwaukee, WI.
53221 and involved a Model #6036 Sky Trak Rough Terrain Forklift Truck.
The platform was being used to perform carpentry functions at the eve
height
of 28 feet above ground elevation at the south elevation of the three story
commercial structure.
Among other methods, one feasible and acceptable means to correct these
hazards is to assure that the design, manufacture and use of all
attachments for
Rough Terrain Forklift Trucks are in accordance with the most current
American National Standard, B56.6 (presently B56.6-1987), and/or has the
prior approval of the lift truck manufacturer.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
