Section 5(a)(1) of the Occupational Safety and Health Act of 1970:

The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
Prior to the accident which occurred on or about October 23, 1995,
the employer (general contractor) did not monitor the
subcontractor's compliance with General Note Specification S-1
project drawing, which required that grout for filling reinforced
and non-reinforced cells be placed in maximum of 4 foot lifts, and
that such cells be fully grouted; and the general contractor did
not ensure that the walls were adequately braced.
A feasible and useful means of abatement includes, but is not
limited to the following actions:
1.Ensure that the general contractor's personnel are properly
trained to recognize the standards, work practices and
recommendations found in the American Concrete Institute
(ACI), the Manual of Concrete Practice (Part 5-1991), the
National Concrete Masonry Association (NCMA-TEK), and other
recommendations found in Masonry Design And Detailing for
grouting and bracing.
2. Ensure that job-specific project drawing specifications are
followed.
3. Devise a means of communication between the general contractor
and the subcontractor(s) to ensure that safety-related work
practices are known, understood and implemented at the job
site.
