Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employee(s) at Vintage Car Wash located at 6237 N. Mesa, El Paso,Tx, were exposed to the hazards of being struck by vehicle associated with modified or handicapped vehicles. An employee is required to drive customer vehicles either of the automatic transmission type,standard transmission type or, on occasion,vehicles equipped with handicapped controls. Feasible and acceptable methods to correct this hazard include, but are not limited to, the following: a) Provide written standard operating procedures that will require the customer of a handicapped vehicle to drive his or her own vehicle to the work area. b) Install mirrors in front of each bay so that the driver is able to guide himself over the pit area without the use of a second person to stand in front of a vehicle for purpose of directing a driver. c) assure that employee(s) do not stand in front of vehicles while directing drivers into the bays.
