Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by fragments of steel and glass from a bursting tank due to the over pressurization of the vacuum receiving tank during maintenance test operations in the Compound Room on 9/20/89. One feasible and acceptable abatement method among others is to install protection devices and/or establish, implement and enforce operation procedures for detecting leaks in non-pressure vessels that does not require use of air.
