Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to blood and blood contaminated saliva and/or gingival fluid
that could result in employee infection with the HBV and/or HIV:
a)  Dental Office;
All applicable CDC guidelines for the prevention of transmission of
blood borne diseases such as Hepatitis B and Acquired
Immunodeficiency Syndrome (AIDS) were not implemented in that:
1)  A formal and effective infectious disease control program was not
developed or implemented which included employee training on the etiology
and transmission modes of Hepatitis B and Acquired Immunodeficiency Syndrom e
(AIDS) virus.
2)  HBV vaccinations were not offered to all dental assistants or otherwise
exposed employees.
Feasible and acceptable means of abatement include, but are not
limited to:
1.  Provide an explanation to the exposed employees of the epidemiology
and etiology of HBV and HIV transmission as it relates to the
dental practice.
2.  Provide a specific detailed explantion to the exposed employees
of the reasons for Universal Precautions as set down by CDC and
how and why they are to be implemented.
3.  Make available hepatitis B vaccination and prophylaxis to all
exposed employees in accordance with standard medical practice.
AS FEASIBLE MEANS OF ABATEMENT WOULD BE TO ASSURE CONFORMANCE TO THE
CRITERIA REFERENCED IN ISNTA-101, 1983 FOR COMPRESSED AIR TOOLS, AS WELL
AS FOLLOWING BASIC OPERATING PROCEDURES SUCH AS, BUT NOT LIMITED TO:
1) ONLY APPROVED TOOLS SHALL BE USED
2) ONLY QUALIFIED OPERATORS SHALL OPERATE TOOLS.
3) TOOLS SHALL BE OPERATED IN STRICT ACCORDANCE WITH THE MANUFACTURER'S
INSTRUCTIONS.
4) EYE OR FACE PROTECTION, OR BOTH, SHALL BE WORN BY OPERATORS,
ASSISTANTS, AND ADJACENT PERSONNEL WHEN TOOLS ARE IN USE.
5) EACH DAY, PRIOR TO USE, THE OPERATOR SHALL INSPECT THE TOOLS TO
DETERMINE THAT IT IS IN PROPER WORKING CONDITION IN ACCORDANCE WITH
THE TESTING METHODS RECOMMENDED BY THE MANUFACTURER OF THE TOOL.
6) ANY TOOL FOUND NOT BE IN PROPER WORKING CONDITION SHALL BE
IMMEDIATELY REMOVED FROM SERVICE, TAGGED "DEFECTIVE", AND SHALL NOT
BE USED UNTIL IT HAS BEEN PROPERLY REPAIRED IN ACCORDANCE WITH THE
MANUFACTURER'S INSTRUCTION.
7) ONLY THOSE TYPES OF FASTENERS RECOMMENDED BY THE TOOL MANUFACTURER
SHALL BE USED.
8) THE TOOL SHALL ALWAYS BE HELD PERPENDICULAR TO THE WORK SURFACE WHEN
FASTENING INTO ANY MATERIAL, EXCEPT FOR SPECIFIC APPLICATION
RECOMMENDED BY THE TOOL MANUFACTURER.
