Section 5(a)(1) of the Occupational Safety and Health Act of 1970:The employer did not furnish employment and a place of employment which were free from the recognized hazards that were causing or likely to cause death of serious physical harm to employees in that employees were exposed to: a)Employees were exposed to conditions at Pier-57 In Brooklyn, NY at First Ave. and the foot of 57th St. where the structural integrity of the pier was not maintained, which exposed employees to the hazard of falling into the water and being struck by debris from the already partially collapsed pier on or about May 31, 1994 through September 28, 1994 ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard would be the following: (1) Initiate necessary repairs to the pier to restore the structural integrity, as outlined in the condition survey performed by Mueser Rutledge Consulting Engineers between 9/20/89 and 10/2/89 (2) Cessation of all operations at Pier-57 in Brooklyn.s
