Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to severe burns from acetic acid and other heated liquids
during the kettle run
procedure:
(a) Warehouse:  On or about July 20, 1998, an employee sustained severe
burns when
a gasket on the expansion tank blew causing a release of a mixture
containing acetic acid.
Among other methods, feasible and acceptable abatement methods include: 1)
Installing a splash
guard on the expansion tank to protect employees from the spray of any
future releases; 2)
Developing a documented preventative maintenance program which provides
for regular
inspections of all gaskets and pressure relief devices on all equipment
involved in the kettle run
procedure; 3) Installing temperature and pressure switches in line with
the dye kettle so that the
lid cannot be opened unless you are within the appropriate temperature and
pressure ranges; 4)
Developing updated kettle run procedures for this process; and 5) Training
all operators in the
proper operating and inspection procedures, including proper clamping of
the tank lids.
