Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a flying shear-pin: The employer failed to protect his employees from the recognized hazard of being struck by the shear pin on the Gardner Denver safety relief valve, as the shear pin is expelled/sheared by the excessive pressure build-up. The employer could have protected it's employees by placing a cap over the shear relief valve or by other alternative means. This condition existed on August 19, 1997, on Drill Rig number 6, at the W. F. Mauch Number 1, five (5) miles East on FM 136, Gregory, Texas 78358. One (1) feasible and acceptable means of abatement is to cut off the end of the sixty (60) penny nail, in order for it to all fit within the confines of the protective cap and that the protective cap be securely latched as specified in API RP 54-92 Section 8, Sub-Section 8-13, Paragraph 8.13.9, page number 21. *** Certification and Documentation of Abatement required ***
