Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees working in and around the warehouse area and rod break down area were exposed to crushed by equipment in the event of a turn over, of powered industrial trucks when not utilizing the operator restraint system, which were installed by the manufacturer of the powered industrial truck. Consensus standards such to ANSI B56.1a-1989,Addends to ASME ANSI B56.1-1988, and ASME B56.1- 1993, Safety Standard for Low Lift and High Lift Trucks, require the use of operator restraint system during operation of the powered industrial truck. Methods of feasible abatement include, but are not limited to: (1) Use of operator restraint systems provided on powered industrial trucks. (2) Installing operator restraint systems, provided by the manufacturer of the powered industrial truck.
