P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of being thrown out of operators seat: A) Employees were operating industrial forklift trucks without wearing the seatbelts that were provided. This was exposing operators to struck-by / crushed-by hazards, should the forklift be accidentally tipped over, that could result in fatal injuries when their upper body parts were struck/crushed by the lift truck overhead protection device as they were thrown out of the operator seat, on or about 3/21/97. Other feasible and acceptable abatement methods to correct this hazard would be to ensure that employees wear seatbelts while operating industrial trucks.

P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of falling off of crane access platform: A) Cargo vessel NAVA AVRA - Employees had to use a platform, that was missing the top guardrail in different sections, to gain access to the shipboard crane. This was exposing employees to a fall hazard that could result in fatal injuries, on or about 3/21/97. Other feasible and acceptable abatement methods to correct this hazard would be to ensure that all guardrail are in place before allowing employees to use platforms.

This was exposing employees to fall hazards that could result in serious injuries, on or about 3/21/97. Other feasible and acceptable methods to correct this hazard would be to ensure that employees use some type of fall protection when working on top of clay bags.

This exposed employees to a hazard of being struck by falling sections of metal, on or about 3/21/97. Other feasible and acceptable abatement methods to correct this hazard would be to barricade the area off or secure the metal panels back in place.
