Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to crushing and struck-by hazards:
(a)City Electric Inc. (Denali National Park Pedestrian Walkway area): An
employee was
exposed to a caught-in and struck-by hazard while he operated a Case 580
Super L King
Tractor (Model 580, Series 1745) on a 25grade gravel and loose dirt
surface, without
the use of the installed restraint device. Among other methods, one
feasible and
acceptable method to correct the hazard is to mandate and continuously
enforce onsite
usage of seatbelt restraints through retraining and clarity of employer's
work rules.er's
