Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazard:
a) Workplace - On or about 09/07/00, employee(s) working from the platform
of a
Self-Propelled Elevating Work Platform (scissors lift) were exposed to
injuries from
falls due to an unstable surface beneath the equipment.
Among other methods, feasible and acceptable methods to correct the hazard
are:
1)Assure that the following ANSI/SIA 92.6-1990 "Self Propelled Elevating
Work
Platforms" standards are followed:
Section 7, "Responsibilities Of Users", paragraph 7.1: "Basic principles.
The information in
this standard must be supplemented by good job management, safety control,
and the
application of sound principles of safety, training, inspection,
maintenance, application, and
operation, consistent with all the data available regarding the parameters
of intended use and
expected environment. Since the user has direct control over the
application and operation of
aerial platforms, conformance with safety practices in this area is the
responsibility of the
user and the operating personnel, including the operator".
Section 8 "Responsibilities Of Operators", paragraph 8.7: "Workplace
Inspection. Before the
aerial platform is used and during use, the operator shall check the area
in which the aerial
platform is to be used for possible hazards such as, but not limited to:
Inadequate surface and
support to withstand all load forces imposed by the aerial platform in all
operating
configurations".
Section 8.8 "Responsibilities Of Operators" paragraph 8.8: "During
operation. "The aerial
platform shall be used in accordance with this standard. Before each
elevation of the
platform, the operator shall ensure: (1) The aerial platform is operated
on
a surface within
the limits specified by the manufacturer".
2)Develop and implement a policy that operators read, understand and
follow safety rule
Number 4, page 9 in the Marklift Industries Operation & Safety Handbook:
"Make sure the
unit is on a firm and level working surface at all times".
3)Develop and implement a policy that operators read, understand and
follow safety rule
Number 9, page 13 in the Marklift Industries Self-Propelled Scissor
Operation, Maintenance
and Parts Manual: "Do not drive on uneven, sloping or soft terrain that
sets the unit in an
out-of-level condition of more than 6 degrees fore and aft, or 3 degrees
side to side".
