North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees, in that employees were exposed to
being struck by the
collapse of the building due to being over loaded in that the structural
limit of the system was
not rated as to it's capacity (ref para 5.4.2 ASME HST-1M-1989):
a)grinder room-hoist system incorporating 3 electric hoist was not rated
as to the
structural limits of the system or the capacity of the weight limits of
the building
structure to withstand the stress of use.
one possible abatement procedure is for a certified engineer to rate the
structure
as to it's capacity and post it plainly on the overhead beams.ad
