North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to: caught between/crush hazard.
a)site/building/section (3)-employees were operating a TRX-
13 vertical lift, elevated work platform, manufactured by
Strato-Lift & Boom, Inc. which contained the following
altered safety devices:
1)electrically wired to by-pass the key, and allow
the lift to be operated.
2)tilt alarm by-passed when rewired, which could
allow the lift to be out of balance and turn over
without warning.
3)foot pedal locked down which allowed the operator
to move the lift without pressing the pedal down
with their foot.
4)a sensor button located under the work platform
used to slow the speed of the lift while traveling,
was taped over allowing the lift to move at a
faster speed when the platform is in a raised
position.
and the following safety requirement deficiencies as Ref.
ANSI/SIA A92.6-1990:
7.6 the employer did not insure that the operator was
trained in accordance with the manufacturer's operating
manual.
7.7 the employer did not insure that the operator had
read and understood the user's safety rules.
7.9 (5) the operator did not determine that there was
adequate overhead clearance.
7.11.3 the operator did not report problems that affected
the safe operation of the lift.
that resulted in an employee injury,  when on or about
10/29/99, Jeff Barnes, a mechanic for Chisholm Services,
Inc., sub-contractor, installing heating and air
conditioning equipment, was attempting to bring a work
lift inside a building, was caught between the top of a
door frame and the top rail of the work platform of the
lift sustaining head and face injuries.
Among other methods, one feasible and acceptable abatement to
correct the hazard would be to train all employees to follow
the manufacture's "Operations Manual".
