North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a) Watershed Road  --  the employer did not follow the
industry standard for testing water lines on July 30,
1999, when a Town of Mars Hill employee was killed when
he was struck by a reducer which was blown from a water
line by air pressure.
Among other methods, one feasible and acceptable
abatement method to correct this hazard is to instruct
all employees to never use air pressure in a water line
and to enforce this instruction.
