Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were subject to be struck and/or crushed by bales of cardboard
which had shifted
and become unstable in transit: an employee of Choctaw Carriers, Inc. was
fatally injured on
or about May 24, 2001, when he was struck by a load which had shifted as
he prepared to
unload his trailer at the Weyerhaeuser facility in Valliant, Oklahoma.
One feasible and
acceptable method of correcting this hazard is to provide and ensure the
proper and safe use
of load restraining devices.
