Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards that were likely to cause death or serious physical harm from mal-function of the automotive lift. (a) Big O Tires: The Globe, number 4, automotive lift, did not have the manufacturer's identifying data plate placed on the lift, which indicated the rated load capacity of the lifts. (b) Big O Tires: The manufacturer-provided instructions and warning labels were not posted on or near all the lifts. (c) Big O Tires: The employer failed to establish a periodic preventive maintenance program for the lifts, in that, the Globe lift four was not functioning properly and had not been repaired or taken out of service. Among feasible abatement method to correct this hazard, is to follow the requirements as set forth in American National Standards: "Safety Requirements for the Construction, Care and Use of Automotive Lifts". Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
