Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards related to the JLG scissor lift
(SJ9722), located near
the east wall of the gymnasium, being tipped over as a result of operating
(traveling) it in the
close proximity of an unprotected floor opening:
Among other methods, one feasible and acceptable method to correct this
hazard is to ensure
that prior to traveling with the JLG that the work area be inspected for
potential hazards and
during travel ensure that a safe distance be maintained from obstacles,
debris, drop-offs,
holes, openings, depressions, ramps, soft or uneven surfaces as described
in the JLG
operations manual and A92.6-1990 American National Standards Institute
(ANSI) standards
for self-propelled elevating work platforms.
