General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling into a tank containing crude oil: a)On January 2, 2002, an employee was in the process of retrieving a vacuum hose from a hole in the top of a skimmer tank and he sat down on top of the tank to perform this task. Suddenly, the tank's roof (top) collapsed under him and he fell into the oil and water mixture that was inside the tank. Among others, one feasible and acceptable method to correct this hazard is to inspect the tank in accordance with American Petroleum Institute Standard 653, 1992 edition, Section 4, Paragraph 4.1, which states, "Tanks shall be inspected by a qualified inspector" and Section 4, Paragraph 4.3.1.2 which states, "This routine in-service inspection will include a visual inspection of the tank's exterior surface checking for: leaks; shell distortions; signs of settlement; corrosion; and the condition of the foundation."
