Title 40.1-51.1(a) Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazards during concrete pumping operations by replacing the manufacturers flexible boom tip hose that had a rubber discharge end with one that had a steel coupling end. (a) On July 7, 2002, an employee died of injuries he received during a concrete pour on July 3, 2002, when he was struck in the head by the steel-tipped hose attached to a Reed Model XXT32 truck-mounted concrete boom pump. The Operation, Maintenance and Parts Manual for the Reed Model XXT32 truck-mounted concrete boom pump specifically states to use part number C-TT2.FLEX for the discharge hose and further states that no modification is to be made to the machine without prior written consent of the Reed Customer Service Department. One feasible and acceptable method, among others, to correct this hazard is for the employer to only use the correct rubber-tipped hose as recommended by the pumps manufacturer. Proposed penalty: $7,000.00 (b) On July 7, 2002, during a concrete pour, an employee was standing approximately four feet away from the discharge hose of a Reed Model XXT32 truck-mounted concrete boom pump when the hose experienced a blockage. Subsequent to the blockage clearing itself, the hose whipped violently striking the employee who later died as a result of the injury. The Operation, Maintenance and Parts Manual for the Reed Model XXT32 truck-mounted concrete boom pump further specifically states that when a blockage occurs to warn all personnel in the immediate area of the imminent danger and to stay clear of the area. One feasible and acceptable method, among others, to correct this hazard is for the employer to train the hose operators to warn other employees whenever a blockage occurs and to train the employees to get out of the immediate vicinity of the hose until the blockage is cleared.
