North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazards of falling steel beams. a)job site - a commercial ready mix concrete truck was driven into a construction area with overhead obstructions without having a clear sighting of the overhead beams, thereby striking the steel beams, dis-lodging them and causing them to fall and strike an employee. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the driver to exit the vehicle to check for over head obstructions before backing or driving the concrete truck into a partially constructed building.
