Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees:
a)on or about 08:00 AM, September 25, 2002, the employer,  Love Pipe
Construction, Inc., did
not ensure that an employee, working in the area of a Caterpillar
excavator model 325B,
remained outside the swing radius of the bucket thereby exposing the
employee to serious
injury or death by being struck by the excavator bucket or flying debris
falling from the
bucket. The struck-by hazard posed by allowing an employee within the
swing radius of the
bucket is described in the manufacturer's operating instructions.

to correct this hazard can be
found in the manufacturer's operating instructions and in Society of
Automotive
Engineers (SAE) J153,
