Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A crushing injury/death when platforms lifts were put into service without adequate repairs. The platform lift was not maintained, documented and repair in accordance with the acceptable requirements of the American National Safety Standards for Self Propelled Elevating Work Platforms; ANSI/SIA A92.6-1999 Section 7.4-Replacements parts: When parts or components are replaced, they shall be identical or equivalent to original aerial platform parts or components. (a) On and prior to 04/03/04, the Marklift platform lift replacement parts installed on the control lever were not equivalent or identical to the manufacturers parts and/or repaired according to the manufacturers specifications. (b) On or about 03/26/04, the Marklift platform lift up/down control was repaired with parts other then the equivalent of the manufacturers. Among other methods, feasible and acceptable methods to correct the hazard: All replacement parts used and repairs should be equivalent to the manufacturers specifications. Abatement Certification required.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: An crushing/death hazard when faulty repairs and inadequate inspection are made on the self propelled elevating work platform. Employees were exposed to a crushing hazard when powered platform lifts are not properly maintained and inspected in accordance with American National Standard Institute for Self- Propelled Elevating Work Platforms: ANSI/ASI A92.6-1999: Section 7.5-Maintence Training; The user shall assure only qualified personnel inspect and maintain the aerial platform in accordance with the manufacturers recommendations and section 7.3 and 7.4 of this standard. Section 7.13(4): Record Retention and Dissemination: When employees of the user accomplish repairs on the aerial platform, the user shall maintain written records. The record shall include the date of repair, a description of the work accomplished, and identification of the person(s) performing the repair. (a) The employer did not assure the employees conducting repairs to the safety of the lift controls on the Marklift powered platform lift were qualified to perform the repairs and inspect the repairs to assure they were equivalent to the manufacturer's specification. (b) On or about 03/26/04, the Marklift platform lift up/down control was improperly repaired with parts other than the equivalent of the manufacturer specifications. (c) On the Marklift platform lift, the company did not assure that the maintenance records included a description of the work that was accomplished and person(s) performing the repairs. Among other methods, feasible and acceptable methods to correct this hazard; Assure maintenance people are properly trained and/or qualified contractor service all items that could affect the safety of employees. Create a written record of the work accomplished. Abatement Certification required.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing injuries/death when allow to operate a self propelled elevating work platform with a defective lift control were not taken out of service. The employer failed to removed the platform lift from service or repair when safety defects were found as required by American National Standard Institute for Self-Propelled Elevating Work Platforms; ANSI/SIA A92.6-1999: Section 7.3 Inspection and maintence; Users shall inspect and maintain the aerial platform as required to ensure proper operation. Aerial platforms that are not in proper operating condition shall be immediately removed from service.Section 7.10(11): The user shall direct the operator to immediately report to a supervisor any problem(s) or malfunctions(s) that become evident during operation. The user shall ensure all problems and malfunctions are repaired prior to continued use. Section 7.3.3-Prestart inspection: Before use each day or at the beginning of each shift, the aerial platform shall be given a visual and functional test including but not limited to the following; Safety devices. The owners manual affirms proper inspection and maintenance. (a) On or before April 3, 2004, the employer allowed the Marklift elevating work platform to be operated when the control lever for up/down was noted to be defective and not working properly. (b) Inspections were not conducted and documented prior to the last operation of the Marklift. Among other methods, feasible and acceptable methods to correct this hazard: Train maintenance and employees to properly inspect each platform lift prior to use/shift and remove from service any lift found with defects until properly corrected. Abatement Certification required.
