Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing injuries:
(a) Employees were exposed to crushing injuries as a result of working at
or near
the rear of the No. 654 rear load compacting truck, WV License 19-387, that
was being operated without a functional audible warning backup signal, on
or
about January 31, 2005.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS to repair and/or replace the warning
signal in
accordance with ANSI Z245.1 Mobile Refuse Collection and Compaction
Equipment - Safety
Requirements, 6.1.(k), which states that the employer is responsible for
"specifically
inspecting safety equipment and other protective devices to ensure that
these devices are not
disabled or bypassed, and not to permit the operation of mobile equipment
unless these
devices are fully functional."
