Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to electrical and struck by /caught in hazards while performing
maintenance activities:
(a)Starbound LLC, Factory Floor: On or about January 29, 2009, an employee
was
working on the trim line conveyor belt without locking out the hydraulics
for the
conveyor system, exposing the employee to struck by or caught in hazards
in the
event the event was energized.
(b)Starbound LLC, Factory Floor:  On or about January 29, 2009, an employee
locked out the Surimi Skinner and Belly Flap skinner without identifying or
tagging the lock identifying it as a lockout device, the hazard of
removing the
lock, who locked the device out, the date, and the expected date of
removal.
(c)Starbound LLC, Engine Room: On or about January 29, 2009, a contract
employee was working on the Reverse Osmosis system locked out by the
Engineer.  The lock was not identifed or tagged indicating the lock as a
lockout
device, the hazard of removing the lock, who locked the device out, the
date, and
the expected date of removal.
(d)Starbound LLC, Engine Room: On or about January 29, 2009, a contract
employee was working on reverse osmosis equipment in the engine room.
Information regarding the lockout procedures of the F/T Starbound and the
contractor were not communicated prior to the work commencing.
Among other methods, a feasible means of abatement would be to use the
lockout tagout
program in place on the F/T Starbound.
