Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the potential hazard of fire and
explosion:
(a)Plastic Re-grind Room - Sterling cyclones that were handling
combustible plastic dusts were
located in the grinding room, on or about September 27, 2006.
(b)Plastic Re-grind Room - Ductwork from the Cumberland grinder to the
Sterling cyclone used
to handle metalized plastic dust was constructed of non-conductive PVC
which  eliminated the
electrical bond between the processing equipment and the dust collection
equipment,
on or
about September 27, 2006.
(c)Plastic Re-grind Room - Exhaust systems for the Cumberland grinders
were designed in such a
fashion that the materials from the grinders, which included combustible
dusts, passed through
the fans (Blade Machinery Company, Inc.) before entering the Sterling
cyclones, on or about
September 27, 2006.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method to correct these
hazards is to comply with the National Fire Protection Association (NFPA
654) "Standard for the Prevention
of Fire and Dust Explosions from the Manufacturing, Processing and
Handling of Combustible Particulate
Solids" - 2006 as it applies to your operations and equipment including
but not limited to:
Locate dust collection systems outside the building or otherwise comply
with the provisions of
Section 7.13.1.1.2.
Ensure that all system components are conductive or otherwise comply with
the provisions of
Section 9.3.1.2,
Install material handling/exhaust systems that do not require the
combustible materials to be
passes through the air moving devices (fans) or otherwise comply with the
provisions of
Sections 7.12.2.2 or 7.12.2.3.
