Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by the roll over protection structure by operating such equipment and not wearing seat belts. (a)Gulfport, MS. - On or about 4/13/07 Forklift driver operated Pettibone Rough Terrain Forklifts equipped with roll-over protection without wearing seat belts. Among other methods, one feasible and acceptable abatement to correct this hazard is to enforce the wearing of seat belts when operation this type of equipment.
