Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling:
(a) Location - Establishment:
On or about 7/1/05, employees were using a forklift platform without rails
or toe plates
as a work platform.
Among other methods, one feasible and acceptable abatement to correct this
hazard is for
employees to work on a work platform that has a guard rail of not less
than 36 inches
or more than 42 inches around its upper periphery, including a midrail,
and a minimum
four inch toe boards, and also follows the other requirements specified in
ASME B56.1-
1993, Safety Standard for Low Lift and High Lift Trucks, Section 7.35.on
