Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by/caught-between hazards and related crush
injuries from construction
machinery/equipment that was not equipped with ROPS/Seat-Belts and was
operated on and
around terrain which could potentially cause rollover accidents:
A.) Construction Site -- SR 2027 ConSpan Project - Mineral Springs, PA:
The
BoMag compactor (#756/Model BW 210-3) was not equipped with a seat-belt
and ROPS.
The BoMag was utilized on the SR 2027 ConSpan job site which contained
terrain that
was conducive to rollover accidents (e.g. hillsides/drop-offs).  The BoMag
was utilized
for work activities that included but were not limited to the compaction
of soil/fill to
form the hillside that was located adjacent/above the ConSpan.  In
addition,
a wall
formed by concrete blocks and the bank next to the stream created a
drop-off of
approximately 6-feet.
ABATEMENT NOTE:
Among other methods, feasible and acceptable methods of abatement include:
1. Instituting procedures to ensure only construction machinery/equipment
that is
equipped with ROPS and seat-belts are delivered to job sites with terrain
conducive to
rollover accidents.
***AND/OR***
2. Equipping the BoMag compactor with a seat-belt and ROPS.
