T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
On 06/29/2006 a TDOT employee was operating an International bucket truck
at the intersection
of 7th Ave North and James Robertson Parkway.  The vehicle was stationed
in the middle of
the parkway extending into both the East and West bound lanes of traffic
without benefit of
traffic controls, barriers, or vest.  The Manual on Uniform Traffic
Control Devices (MUTCD)
Chapter 6D.03, "Worker Safety Consideration" provides key elements of
worker safety and
temporary traffic control (TTC) management that should be considered to
improve worker
safety.  These are:
(a) Training - all workers should be trained on how to work next to motor
vehicle traffic in a
way that minimizes their vulnerability.
(b) Worker Safety Apparel - all workers exposed to the risks of moving
roadway traffic or
construction equipment should wear high visibility safety apparel meeting
the requirements of
ISEA American National Standard for High Visibility Safety Apparel" and
labeled as ANSI 107-
1999 standard performance for Class 1, 2, or 3 risk exposure. A competent
person designated
by the employer to be responsible for the worker safety plan within the
activity area of the job
site should make the selection of the appropriate class of garment.
(c) Temporary Traffic Barriers - temporary traffic barriers should be
placed along the work
space depending on factors such as lateral clearance of workers from
adjacent traffic, speed of
traffic, duration and type of operations, time of day, and volume of
traffic.
(f) Worker Safety Planning - a competent person designated by the employer
should conduct a
basic hazard assessment for the work site and job classifications required
in the activity area.
This safety professional should determine whether engineering,
administrative, or personal
protection measures should be implemented.  This plan should be in
accordance with the
Occupational Safety and Health Act of 1970, as amended, "General Duty
Clause" Section 5(a)
(1) - Public Law 91 596, 84 Stat. 1590, December 29, 1970, as amended, and
with the
requirement to assess worker risk exposures for each jobsite and job
classification, as per 29
CFR 1926.20 (b)(2) of "Occupational Safety and Health Administration
Regulations, General
Safety and Health Provision" (see Section 1A.11)
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
The Tennessee Department of Transportation (TDOT) develop and implement a
program with
elements above for employees that operate bucket trucks. Additionally,
TDOT
needs to identify
employees that normally would not be required to operate aerial lifts
vehicles outside of their
normal duties but are required to do so under emergency conditions. These
individuals would
then receive training based on the requirement as set forth in the
sections listed above (a)training, (b) worker safety apparel, (c)
temporary traffic barriers, and (f) worker safety planning
as determined by the Department's competent person.
This training would be documented and recorded. The record would become
part of the
employee's training record.
The selection of safety vests would be chosen by the competent person as
specified in paragraph
(b).  These vests would then be stored on the vehicle.  Access to safety
type II vest equipment
would be available to the operator and other employees working on or
around the lift where
traffic is present near the aerial lift.
A written policy needs to be developed, implemented, and communicated to
all
employees that
no person will be allowed to operate, ride, or perform work in the bucket
of the articulating arm
until they have received all necessary training.  Any person who allows an
unauthorized
individual to do so is subject to disciplinary action up to and including
termination.
