North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to death and serious injury from fall from or
collapse of a load being ridden:
a)222 Glenwood Ave.-employee was standing upon/riding a live load of a
double T section of
parking deck under construction, approximately 30 feet from the ground
(ref. recognized
industry standard, operators manual for Manitowoc model 888 lattice boom
crane, recognized
hazard of riding the load in 1926.753(c)(3) ).
One feasible means of abatement would be to lower the load to the ground
for any alterations
or trimming before lifting in place.g
