Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to a crush by hazard from not
wearing a seat belt
while operating machinery.
(a)Sonics on Highway 42 E - On or about 10/18/07 an employee was operating
a
Skytark (#6042) without wearing a seat belt.
Among other methods, one feasible and acceptable abatement methods to
correct this hazard
included but not limited to:
Instruct employees to wear seat belts when operating equipment.
