Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer
did not furnish to each of his employees a place of employment which was free fr
om recognized hazards that were causing or likely to cause death or serious phys
ical harm to employees in that employees were exposed to the recognized hazard o
f falling from the basket of JLG Model 40H, Serial # 1020990300046121, as a resu
lt of the aerial lift tipping over due to uneven ground. In addition, ANSI A92.2
-2001 Vehicle-Mounted Elevating and Rotating Aerial Devices paragraph 9.5 Mobile
Operation...Before and during driving, the driver shall: (1) Avoid traveling on
any surface that adversely affects vehicle stability. Among other methods, one
feasible and acceptable abatement method to correct this hazard is to ensure tha
t the operator of the aerial lift never operates the aerial lift on
uneven surfaces as instructed by the manufacturer. DISCLAIMERS: 1) You are not l
