Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard from the equipment rolling-over: a)Maintenance shop: On or about April 2, 2008 and times prior thereto, a John Deere row-crop utility tractor, equipped with a Edwards Equipment reverse steering fork lift attachment kit, was operated on the public highway at full speed, with the operator facing backwards. Note 1) One feasible and acceptable means of abatement is to obtain a rough terrain powered industrial truck that will operate safely on paved and unpaved roads, which the operator has the option to face forward when traveling. Note 2) Abatement certification is required for this item.
