Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall and struck-by hazards. (a)Doyle Shamrock Molded Plastics, 1440 Holloway Road, Holland, Ohio: On or about February 24, 2009, the employer did not ensure that the personnel platform was used in a safe manner. Employees were on the platform and transported through the facility which exposed them to a struck-by hazard in the event they were thrown from the platform and hit by the fork truck. The platform was not securely attached to the fork truck carriage which would allow the platform to slide off the forks and throw the employees to the concrete floor. One feasible and acceptable method of abatement to correct this hazard is to ensure that the personnel platform used to elevate workers is used in compliance with the requirements set forth in ANSI/ITSDF B56.1-2005, Safety Standard for Low Lift and High Lift Trucks, Section 4.17 Elevating Personnel. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of being struck by material carried by the crane if the material were disengaged from the crane hook due to a broken safety latch: (a)Doyle Shamrock Molded Plastics, 1440 Holloway Road, Holland, Ohio: On or about March 24, 2009, the employer did not ensure that the hook for the 3 ton model T-456-2R, serial number 233262 crane in the injection molding area was provided with an effective safety latch. The safety latch was bent and would not close the hook's throat. The crane was used to move injection molds weighing an estimated 1,000 pounds. Among other methods, a feasible abatement method to correct this hazard is to comply with the requirements of ASME B30.10-2005 "Safety Standards for Cableways, Cranes, Hoists, Hooks, Jacks, and Slings" Section 10-1.2.1.3 (c) Hooks having any of the following conditions shall be removed from service until repaired or replaced, . . (5) Inoperative Latch. Any latch that does not close the hook's throat; Section 10.1.2.3 (c) A hook latch, when required, that is inoperative shall be replaced or repaired; and Section 10.1.2.3 (d) A hook with a latch that does not close the throat opening shall be removed from service or moused until the latch is replaced or repaired. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
