Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration or other fire hazards from either the lack of a dust collection system or inadequately designed dust collection systems where aluminum dust was generated: Metal Fabrication Area: In the following instances, adequate dust collection systems had not been provided where aluminum dust was generated: A.Cemco 1000 horizontal belt sander: 1.The dust collection system did not capture all the dust. Fugitive dust was observed on the motor housing and floor. (NFPA 484, Section 6.3.2.1) 2.The area was not adequately posted regarding combustible dust hazards. (NFPA 484, Sections 6.3.2.5.3 and 6.3.2.6.1) 3.Flexible plastic duct used to connect the belt sander to the rigid pipe and the KEI dust collector to the rigid pipe were not conductive and was not smooth on the inside. Because the flexible duct was not metallic, the belt sander, duct work and dust collector could not be electrically bonded. The corrugated interior of the plastic duct could allow dust to become trapped and accumulate. (NFPA 484, Section 6.3.3.5.1) 4.The fabric bag used at the KEI dust collector was not an anti-static bag designed to dissipate static build-up. (NFPA 484, Section 6.3.5.2) 5.The flexible plastic duct provided in the outside dust collector shed had holes that allowed the dust to escape from the collection system and accumulate on the floor of the shed. The dust was several inches thick. The dust collector was not cleaned daily. (NFPA 484 Sections 6.3.5.5 and 6.4.2.1) 6.The KEI dust collector was not provided with deflagration venting. (NFPA 484 Section 6.3.5.6) B.Strippit finishing center: 1.The dust collection system did not capture all the dust. Fugitive dust was observed on the motor housing, ductwork, dust collector and floor. (NFPA 484 Section 6.3.2.1) 2.The Dayton barrel mounted, dry-type dust collector was located inside of the building. (NFPA 484 Section 6.3.2.5) 3.The area was not adequately posted regarding combustible dust hazards. (NFPA 484 Sections 6.3.2.5.3 and 6.3.2.6.1) 4.Flexible plastic duct used to connect the belt sander to the rigid pipe on the dust collector was not metallic and was not smooth on the inside. Because the flexible duct was not metallic, the belt sander, duct work and dust collector could not be electrically bonded. The corrugated interior of the plastic duct could allow dust to become trapped and accumulate. (NFPA 484 Section 6.3.3.5.1) 5.The fabric bag used at the Dayton dust collector was not an anti-static bag designed to dissipate static build-up. (NFPA 484 Section 6.3.5.2) 6.The area surrounding machine and dust collector was not cleaned daily and had combustible dust had accumulated on the floor. (NFPA 484 Sections 6.3.5.5 and 6.4.2.1) 7.The dust collector was not provided with deflagration venting. (NFPA Section 6.3.5.6) C.Hand Deburring Work Area: 1.A dust collection system had not been provided to capture dust generated from deburring of parts using either a hand sander or sanding sponges. (NFPA 484 Section 6.3.2.1) 2.Aluminum dust had accumulated in the work area. (NFPA 484 Section 6.4.2.1) Abatement Note: Relevent portions of The National Fire Protection Association (NFPA) Standard for Combustible Metals, NFPA 484 are included for reference for abatement purposes.
