Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fractures and crushing injuries due to the roll-over
and/or collision of powered
industrial trucks:
Yard/Storage Area - Seat belts were not worn by employees operating
forklifts on or
adjacent to uneven surfaces, ramps, loading docks, and vehicular traffic
lanes.  Seat belts
in forklifts are a component of an operator restraint system that is
designed to reduce the
incidence and severity of injuries to the operator in the event of a
roll-over accident.
Among other methods, one feasible and acceptable method to abate this item
is to ensure that
all powered industrial trucks are equipped with seat belts and employees
are required to use
them.red
