Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Date: On or about 5/11/2009 & approximately 3:00pm. Location: On the south side of the Starlite Skating Center located & 3710 North Henry Blvd. Stockbridge, Georgia 30281 Condition: Employee was observed working from an elevated work platform approximately 14 feet above the ground level on a Skytrak #412-06-5207 #6042 JLG Model Rough Terrain Forklift Truck without a personal fall arrest system or guardrail system. The employee was using the Skytrak rough terrain forklift to ride the forks, pallet, and mask to access the edge of the roof to hand gutters. Among other means, one feasible and acceptable abatement method would be to provide a platform which complies with the design requirements listed in the American Society of Mechanical Engineers B56.6-1992 Section 5.15 Elevating Personnel. The employee was instructed to get down and not perform this unsafe operation again. Abatement was completed on the job site during the inspection on 5-12-2009. No abatement certification or documentation is required for this item.
