Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by moving vehicles: At the job site, at the overpass construction between Exit 60 and Exit 62, Interstate 540, Fayetteville, Arkansas, employees were allowed to cross on foot, four lanes of north and south bound traffic on Interstate- 540, exposing the employees to the hazard of being struck by a moving vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure the employer follows the Manual on Uniform Traffic Control Devices, Millennium Edition, Chapters 6B and 6D, to develop a temporary traffic control plan which details how employees would access or exit their construction workzone without bringing them into conflict with vehicles moving through or around the worksite.
