North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling to lower level: a)facility - for exposed employees required to access the Caterpillar 330L Excavator (with shear attachment) for maintenance and operation when the manufactured hand-hold installed on the windscreen frame had been removed. b)facility - for exposed employees required to access the Caterpillar 330L Excavator (with shear attachment) for maintenance and operation when the manufactured mounting steps were bent and had broken welds. Reference: Maintenance Manual for the Caterpillar 330 and 330L Excavator, page 111, "Walk- Around Inspection", and Safety Section page 11, "Mounting and Dismounting". Abatement Note: One acceptable method of abatement, among others, is to repair and replace all manufactured hand-holds and steps as stipulated in the operators' and maintenance manual.ance
