Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The emp loyer failed to furnish employment and a place of employment which was free from recognized hazards for employees cleaning windows at the MGM GRAND Hotel as fol lows: a.Prior to accessing the facade of the MGM GRAND Hotel, the building exter ior was not visually inspected as follows: Two employees from American Glass wer e observed outside of the west side of the main building performing window washi ng activities from a swing stage. At the roof level, there was observed several holes in the edge of the parapet wall, also observed an electrical cord and life lines in these holes without any padding to protect them from abrasion or cuts. In addition, the lines from the swing stage were very close to the gold light fixtures of the MGM GRAND NAME . Reference: ANSI/IWCA I-14.1-2001, Window Clean Safety, Part A General and Perf ormance Requirements, Section 5.8.5, "Prior to accessing the facade, the buildin g exterior shall be visually inspected and, where necessary, appropriate measure s shall be taken to ensure that building features, such as sharp edges of parape ts, window frames, open projected windows and cornices or overhangs cannot impai r the structural integrity of the suspended scaffolding or associated fall prote ction rigging. These measures shall be incorporated into the work plan in accord ance with Section 1.7 of this Standard. b.The employer did not, prior to use, in spect the platform (swing stage). The components of the powered platform, such a s safety devices, wire ropes, and electrical devices, were not checked for their general condition as follows: The electrical cord that powers the stage was found with damaged insulation and failed strain relief. In addition the electrical cord was observed tied around t he corner of the swing stage and taped. Reference: ANSI/IWCA I-14.1-2001, Window Clean Safety, Section 5.9.4, "Prior to use, the platform shall be inspected by a competent person. Specifically, the components of the powered platform and all safety devices including motors, brakes, wire rope, stirrups/hangers, decking, guardrail, electrical devices, rigging equipment, ropes, harnesses, rope grabs a nd lanyards shall be checked for their general condition. Those components which have defects shall be immediately removed from service, tagged or marked with a label which states. "Dangerous, Do Not Use", then restored or destroyed. Improv ised repairs are prohibited. The unit shall not be used until repairs have been made and the platform re-inspected.The employees performing the window washing w ork at the MGM GRAND were exposed to possible serious injuries or death from fal ls of up to approximately 320 feet to the west roof level below. One feasible means of abatement would be to ensure that all aspects of the ANSI/IWCA I-14.1-2001 Window Cleaning Safety s tandard are followed.
